A New York man has filed suit against Carson Smithfield, LLC claiming the debt collector failed to properly inform him of his rights under the Fair Debt Collection Practices Act.
A New York man has filed suit against Carson Smithfield, LLC claiming the debt collector failed to properly inform him of his rights under the Fair Debt Collection Practices Act (FDCPA). The plaintiff says Carson Smithfield sent him a letter informing him that his alleged debt would be considered valid unless he disputed it “verbally or in writing” within 30 days of receiving the letter. The suit argues that the FDCPA requires disputes to be made only in writing, and that a verbal dispute would fail to cease collection efforts. The plaintiff claims that upon learning this information, he “felt annoyed, confused and surprised that [the defendant] would fail to provide him with accurate information concerning his rights under federal law.”
