A New York man has filed suit against Capital Management Services, L.P. over claims that the company failed to clearly convey in a collection notice his amount of debt.

A New York man has filed suit against Capital Management Services, L.P. over claims that the company failed to clearly convey in a collection notice his amount of debt. The plaintiff allegedly received a letter from the debt collector specifying his account balance but noting that the amount “may vary from day to day” as a result of “interest, late charges, and other charges.” The suit argues that because the defendant did not supply more specific information – such as the interest rate, the nature of the other charges, and dates of accrual – the plaintiff was left unable to calculate the true amount of his balance and respond to the letter accordingly.
