Account Control Technology, Inc. is the defendant in a proposed class action lawsuit filed by a New York man who claims the debt collector sent him a misleading letter regarding an alleged obligation. According to the complaint, the letter contained an itemized list of charges supposedly owed by the plaintiff, including “Interest” and “Fees & Costs.” Nowhere else in the letter, however, does the defendant mention that the balance will continue to increase due to interest and added fees, the suit argues.
The case alleges that the debt collector was obligated to clearly communicate the man’s “amount of debt” but failed to provide him with enough information, such as the interest rate, date of accrual, and nature of the additional charges, to determine how much he truly owed at any given moment in the future.
