Tommy Bahama, Ruby Tuesday, Boston Market, the New York Botanical Garden and Bob’s Discount Furniture are the latest heavy hitters to be named as defendants in class action lawsuits claiming the companies’ websites fall out of compliance with the Americans with Disabilities Act (ADA). Filed by the same New York law firm (and named plaintiff) behind many other ADA website compliance actions against retailers, tourist attractions and restaurants, the lawsuits all claim the companies’ websites are nearly impossible to use for visually impaired and hard-of-sight individuals.
According to the complaint, the plaintiff, who is visually impaired, and proposed class members are unable to independently navigate and make transactions on the defendants’ websites due to accessibility barriers. These tech obstacles, not to mention the sites’ exclusively digital interfaces, the suits claim, prevent visually disabled consumers from utilizing widely used assistive software.
