Debt Collector Arstrat, LLC is the defendant in a lawsuit claiming it failed to name in a collection notice a consumer's original creditor.
A proposed class action filed in New York alleges defendant Arstrat, LLC violated the Fair Debt Collection Practices Act (FDCPA) when it sent the plaintiff a collection notice over a debt allegedly owed to North Shore-LIJ Medical Group that failed to properly identify the original creditor to whom the debt was owed. The case says the notice lists North Shore-LIJ Medical Group under “client name” yet fails to indicate if that refers to the plaintiff’s original creditor. The lawsuit argues the defendant’s alleged failure to satisfy this FDCPA requirement could lead the least sophisticated consumer to be unsure as to which party he or she must submit payments to satisfy the debt.
