A proposed class action case over alleged Fair Debt Collection Practices Act (FDCPA) abuses claims frequent defendant ARS National Services again sent to consumers collection notices that failed to note whether stated account balances may increase due to accruing interest or fees. The latest lawsuit, out of New York, argues ARS Nation Services sent the plaintiff a collection notice that lacked any insight into possibly accruing interest and/or fees – an omission that may be viewed as deceptive or misleading under the FDCPA’s least sophisticated consumer criteria.
