United Collection Bureau, Inc. (UCB) is facing a proposed class action lawsuit that alleges violations of the Fair Debt Collection Practices Act (FDCPA).
United Collection Bureau, Inc. (UCB) is facing a proposed class action lawsuit that alleges violations of the Fair Debt Collection Practices Act (FDCPA). According to the complaint, the plaintiff received a collection letter from UCB that stated the following:
“As of the date of this letter, you owe the above stated New Balance Amount. Because of interest and/or other charges that may vary from day to day, the amount due on the day you pay may be greater. Hence, if you pay the amount shown above, an adjustment may be necessary after your payment is received.”
The suit argues that the letter failed to comply with the FDCPA because it did not specify the plaintiff’s minimum amount owed, did not provide her the information needed to determine the amount required to pay off the debt, and did not contain an explanation of extra charges, such as interest and fees, that would cause the amount of her balance to increase. As a result, the complaint claims, the letter failed to “clearly and accurately” convey the amount of debt, as required under the FDCPA.
