A blind NY man claims Nutrisystem.com contains access barriers that prevent visually impaired folks from being able to independently navigate the site.
A proposed class action lawsuit seeks to take Nutrisystem, Inc. to task for its alleged failure to design and operate its website, Nutrisystem.com, to be fully accessible to and independently usable by blind and visually impaired individuals covered by the Americans with Disabilities Act (ADA). The lawsuit, filed in New York, claims Nutrisystem.com violates the ADA because the site is not accessible to screen-reading software commonly used by blind individuals to independently navigate the internet.
The plaintiff, a blind New York man, claims he encountered numerous access barriers on Nutrisystem.com that left him unable to learn about the schedule of the defendant’s live programs; how to purchase products online; special events; online gift card purchases; and warnings regarding the use of Nutrisystem’s products.
