Several entities have been named as defendants in a lawsuit that alleges they failed to provide employees with at least 60 days' notice before laying off workers.
The below entities have been named as defendants in a proposed class action that alleges they failed to provide full-time employees with at least 60 days’ notice—as required by the Worker Adjustment and Retraining Notification Act (WARN Act)—before laying off more than 50 workers in October 2012 at West Virginia’s Pay Car Mine coal mining facility:
- Pay Car Mining, Inc.
- Bluestone Industries, Inc.
- Bluestone Coal Corp.
- Keystone Service Industries, Inc.
- Mechel Bluestone, Inc.
The plaintiff who filed the suit claims he was laid off without prior notice on October 20, 2012, when “at or about the beginning of the second shift, the defendants ordered and carried out a mass layoff at the Pay Car Mine.”
