The official website for the Nucor class action settlement can be found at NucorDataSettlement.com.
The deal, which was granted preliminary approval by the court in late August 2024, covers anyone who received notice from Nucor that their personal information was potentially compromised in the data breach discovered around June 1, 2023.
Only class members who submit a valid claim form online or by mail by December 30, 2024 will be eligible to receive a Nucor settlement payout.
You can file a claim form online on this page, or you may download a PDF claim form to print and return by mail.
To submit a claim online, you will need to provide your unique login and password, which can be found on the settlement notice you should have received in the mail.
As part of the deal with Nucor, eligible class members can file a claim for up to $750 per person for unreimbursed out-of-pocket losses that are “fairly traceable” to the incident and supported by documentation, the settlement website says.
According to the site, consumers are also eligible to receive reimbursement for up to four hours of lost time spent handling issues related to the data breach, at a rate of $17.50 per hour and subject to the same $750 cap for out-of-pocket expenses.
In addition, class members may submit a claim for reimbursement of documented “extraordinary” losses if their identity was stolen as a result of the incident, for up to $7,500 per person, the website relays.
Lastly, class members who did not previously accept Nucor’s offer of complimentary credit monitoring services in June 2023 may file a claim to receive two years of these services at no cost, the site shares.
The court will decide whether to grant final approval to the terms of the Nucor settlement at a hearing on January 13, 2025 in Raleigh, North Carolina. The settlement agreement states that if the deal is ultimately approved, benefits will be issued to eligible class members within 60 days of the date the settlement goes into effect, or within 30 days of when the last claim is approved, whichever is later.
The lawsuit against Nucor alleged that negligent cybersecurity on the company’s part resulted in unauthorized access to certain files via a vulnerability in third-party software used to transfer large documents. The cyberattack, which occurred between approximately May 26 and June 1, 2023, compromised individuals’ names, bank account numbers, routing numbers and certain amounts deposited into their accounts, the data breach lawsuit said.
