Northstar Location Services LLC violated the Fair Debt Collection Practices Act (FDCPA) in a communication it sent to a consumer, a proposed class action lawsuit claims. According to the lawsuit, Northstar sent the plaintiff, a New York resident, a collection notice that is “open to one of multiple interpretations and would likely be misunderstood by an unsophisticated consumer.” In question is the defendant’s alleged omission of safe harbor language meant to notify the debtor whether the stated balance owed could possibly increase due to the accrual of interest and/or fees.
