Costa v. Nissan North America, Inc.
Filed: July 20, 2018 ◆§ 1:18-cv-11523
Nissan North America, Inc. has been hit with a proposed class action alleging its 2013-2014 Altima vehicles contain a defective continuously variable transmission (CVT).
According to the lawsuit, the defect causes Altima drivers to experience “shuddering, hesitation, stalling, unusual noises, and ultimately, premature transmission failure” in their vehicles. The case alleges that Nissan knew the CVT systems in its Altima vehicles were defective but failed to warn consumers when they purchased or leased the cars. Even worse, the case claims the defendant now refuses to pay for the cost of repairs, leaving drivers who must replace their transmissions with a hefty bill that many times exceeds $3,000.
The plaintiff argues that the defendant’s deceptive marketing tactics have left her with a vehicle worth less than what she paid for it and may present a safety hazard to her and other drivers on the road.
