Nissan North America, Inc. is once again facing a proposed class action lawsuit over an alleged defect in the continuously variable transmissions (CVTs) of its Sentra vehicles.
Nissan North America, Inc. is once again facing a proposed class action lawsuit over an alleged defect in the continuously variable transmissions (CVTs) of its Sentra vehicles. The complaint claims model year 2013 vehicles up through the present models are equipped with faulty transmissions that result in “violent jerking,” hesitation, or complete failure during acceleration, presenting a safety risk to drivers. According to the suit, Nissan has known about the problem for years but neglected to disclose the potential issue to consumers or cover the cost of repairing or recalling the vehicles. The defendant allegedly issued several technical service bulletins that “underrepresented” the supposed defect and failed to correct it.
The five named plaintiffs say their Sentras are still exhibiting the same problems despite their attempts to have the cars fixed. They claim they would never have purchased the vehicles, or would have paid less for them, had Nissan disclosed the existence of the alleged defect.
