On the heels of a recent settlement in Florida, a proposed class action lawsuit has been filed against Nissan North America, Inc., this time in Texas federal court.
On the heels of a recent settlement in Florida, a proposed class action lawsuit has been filed against Nissan North America, Inc., this time in Texas federal court. The suit claims that 2007 to 2009 Nissan Altima models suffer an alleged defect that causes their dashboards to melt when exposed to sunlight. The melted material supposedly becomes sticky and reflective, producing a glare on the vehicles’ windshields and obstructing drivers’ vision. According to the complaint, there have been at least two reported accidents as a result of the alleged defect. The suit argues that Nissan had “exclusive and superior knowledge” of the issue but failed to warn consumers, “who had no way to reasonably discover the problem before buying and driving their vehicles.”
A similar case was recently settled in January of this year, but only covers residents of Florida, according to the complaint. The Texas suit seeks to represent “all persons residing in Texas who purchased or leased a model year 2007-2009 Nissan Altima.”
