Nibco, Inc. is the defendant in a proposed class action filed in New York that centers on the company’s allegedly defective cross-linked polyethylene—PEX—plumbing tubes. The 20-page lawsuit alleges the product, including its fittings, crimps and clamps, fail prematurely due to undisclosed design and manufacturing defects.
According to the case, the defendant’s PEX plumbing, which the company touts as “the highest quality PEX tubing available” and warranties to be free from defects for between 10 and 25 years, is defective as the result of poor material selection, shoddy testing, and inadequate development and design. Alleging Nibco’s PEX plumbing tubes fail “routinely,” the case more specifically claims the tubing is “predisposed to premature oxidative degradation, failure and rupture,” while the PEX Fittings are prone to dezincification corrosion. PEX clamps, the case continues, supposedly fail due to “chloride-induced stress corrosion cracking.”
The cumulative result of these issues, the suit alleges, is flooding and extensive property damage.
