A disabled woman is the plaintiff in a proposed class action lawsuit against Kyne’s Corner, LLC, which owns and operates a restaurant called Two Boots, and the restaurant’s landlord. The plaintiff claims that Kyne’s Corner failed to make its restaurant accessible to people in wheelchairs by neglecting to remove “readily achievable architectural barriers.” The restaurant allegedly has an entrance with “insufficient maneuvering clearance” and a five-inch step in front, in addition to bathrooms that are not wheelchair accessible.
By their failure to remove access barriers, the defendants imply that the “patronage or custom” of disabled people is “unwelcome, objectionable, and not acceptable,” the complaint argues. It further claims that “[i]f an individual with a disability is dissuaded from entering or receiving the services of a public accommodation because of the existence of an architectural barrier, the landlord and tenant will be liable for discrimination.”
