NCB Management Services, Inc. has been hit with a proposed class action lawsuit in New York alleging the company violated the Fair Debt Collection Practices Act (FDCPA). According to the lawsuit, the plaintiff received a letter from the defendant about a debt said to be owed to Webbank. The letter, the suit continues, stated that a balance of $2,051.32 was owed “as of 8-16-2016.” The plaintiff alleges that the “least sophisticated consumer” could be confused as to whether additional fees could be tacked onto this balance, calling the language in the letter a violation of federal law.
