New York Consumer Claims Allied Interstate Misrepresented Her Debt Dispute Rights

A lawsuit alleges that Allied Interstate sent a collection notice to a New York consumer that miscommunicated her right to dispute her debt.
A proposed class action filed against Allied Interstate LLC alleges the debt collector sent a letter to a New York consumer that miscommunicated the woman’s right to dispute her debt by implying that a dispute can only be made in writing.
The plaintiff claims she received a letter from the defendant in October 2017 that stated, in part:
“Correspond with Allied (other than payments at: Allied Interstate LLC, PO Box 361774, Columbus, OH 43236.”
The lawsuit argues that this language misrepresented the plaintiff’s debt dispute rights in that it suggested a dispute can only be submitted in writing to the address listed above. The case alleges the defendant violated the Fair Debt Collection Practices Act by using misleading representations and failing to comply with the Act’s validation notice requirements.
