Selip & Stylianou is staring down a lawsuit that claims the collection agency failed to respond to a consumer’s request for validation of an alleged debt.
Selip & Stylianou, LLP is staring down a proposed class action lawsuit that claims the collection agency failed to respond to a New York consumer’s request for validation of an alleged debt.
According to the case, the plaintiff received an initial collection notice from the defendant in July 2018, to which he responded a month later by requesting validation of the supposed obligation. The suit says that after receiving the man’s written request, the agency was required to cease all collection activities until validation of the debt was provided. Nevertheless, the defendant went on to file an action against the consumer without first providing the requested validation, the case charges.
“The consumer’s right of validation is a fundamental right, and continued collection after a validation request is tantamount to intentional harassment,” the complaint reads.
