Needelman v. New River Hospitality Holdings, Llc
Filed: June 26, 2018 ◆§ 1:18cv22577
New River Hospitality Holdings is the defendant in a lawsuit claiming the Ft. Lauderdale restaurant operator engaged in unsolicited text message marketing.
Florida
New River Hospitality Holdings, LLC is the defendant in a proposed class action in which the plaintiff claims the Fort Lauderdale restaurant operator broke the law by engaging in unsolicited marketing.
The plaintiff claims the defendant sent him a text message in April 2018 advertising that he could receive $10 off any order of $25 or more from New River Pizza. According to the case, at no time did the plaintiff provide New River Hospitality Holdings with express written consent to contact him by way of an automatic telephone dialing system. The impersonal nature of the text message indicates it was sent to consumers en masse “in an automated fashion without human intervention,” the lawsuit claims.
