Nearly $4.5M Lightricks Settlement Resolves Lawsuit Over Alleged Biometric Privacy Violations

Lightricks, Ltd. and Lightricks US, Inc. have agreed to pay nearly $4.5 million to resolve a proposed class action lawsuit that alleged their mobile apps collected and stored users’ biometric data in violation of an Illinois privacy law.

The deal, which was preliminarily approved by the court on September 26, 2024, covers anyone in Illinois, including minors, whose image or voice was analyzed by a Lightricks app—namely, Facetune, Photoleap, Videoleap and LTX Studio—at any time between September 30, 2017 and November 25, 2024.
To receive a pro-rated share of the $4,485,000 settlement fund, class members must file a claim form online or by mail by December 23, 2024.

In order to file a claim online, you will need your unique Class Member ID, which is typically included on the personalized settlement notice class members were issued to inform them of the deal.

According to the site, class members who submit a valid claim form by the December deadline will be eligible to receive a cash payout of up to $60, though final payment amounts may increase or decrease on a pro rata basis.
The parties now await a hearing scheduled for January 6, 2025 in Illinois, at which time the court will decide whether to grant final approval to the terms of the deal. Payouts will be distributed to eligible class members only if the settlement is granted ultimate approval, and after any appeals are resolved, the website says.
The lawsuit against Lightricks claimed the app developers violated the Illinois Biometric Information Privacy Act (BIPA), a law enacted to protect Illinois consumers from the harms associated with the unauthorized collection of their sensitive biometric data. According to the class action suit, Lightricks ran afoul of the BIPA by capturing and storing the biometric information of Facetune, Photoleap, Videoleap and LTX Studio users without first obtaining prior written authorization.
