Nationwide Credit Inc. and Chase Bank USA N.A. are facing a proposed class action filed by a Wisconsin consumer who claims the defendants sent her misleading information regarding her alleged debt.

Nationwide Credit Inc. (NCI) and Chase Bank USA N.A. are facing a proposed class action filed by a Wisconsin consumer who claims the defendants sent her misleading information regarding her alleged debt. According to the complaint, the plaintiff received a bank statement from Chase indicating that she owed a “New Balance” of $641.03, with a “Past Due Amount” of $90.00, a “Payment Due Date” of March 28, 2017, and a “Minimum Payment Due” of $105.00. During the same billing cycle, however, the plaintiff also received a debt collection letter from NCI informing her that her “account balance” was $641.03, the complaint notes.
The suit argues that the two documents contradict each other and that the defendants, therefore, misrepresented the amount the plaintiff allegedly owed. Furthermore, the case claims, the defendants were not permitted to accelerate the loan and demand the full amount before sending the plaintiff notice of her right to “cure default.”
