A proposed class action filed in New York claims defendant NCC Business Services Inc. broke federal debt collection laws by failing to clearly list the “current balance owed” in notices sent to proposed class members. Citing alleged Fair Debt Collection Practices Act violations, the lawsuit claims NCC Business Services sent collection notices that would likely be misconstrued from the perspective of the least sophisticated consumer since they failed to disclose whether balances may increase due to interest or fees. The case alleges this conduct may lead the debtor to be unsure as to whether payment of the stated balance would fully satisfy a debt.
