Nationwide Funding Group Corp. is the defendant in a proposed class action that takes issue with allegedly unsolicited fax advertisements sent by the lender.
The plaintiff, a Connellsville, Pennsylvania building material company, claims to have received a fax from the defendant in April 2018 informing the company of its pre-approval for a working capital loan. The plaintiff alleges it did not provide prior express consent to receive fax advertisements from Nationwide, nor did it have any prior relationship with the lender.
The case further charges the unsolicited fax failed to display a proper opt-out notice as required by the Junk Fax Prevention Act.
