A now-settled lawsuit claimed Nationwide Credit failed to disclose to a consumer whether her debt may increase from accruing interest and fees.
Nationwide Credit at the end of September was hit with a now-settled proposed class action lawsuit over alleged violations of the Fair Debt Collection Practices Act. The plaintiff, who submitted a notice of settlement on October 18, claimed in the suit that the defendant mailed her a collection notice in November 2016 that failed to inform her whether the amount listed was the actual amount due, since the notice allegedly did not expand on any accrued interest or fees, nor state what portion of the balance was principal. The plaintiff further claims the letter did not indicate the minimum amount owed at the time the letter was sent and if the balance may increase in the future.
