Nationwide Credit, Inc. is facing a proposed class action lawsuit filed by a New York man who claims he received a collection letter from the defendant that failed to clearly state the amount of his alleged debt in accordance with the Fair Debt Collection Practices Act (FDCPA). According to the complaint, the letter contained an “Account Balance,” but neglected to mention whether the balance would increase due to interest or other fees. The plaintiff says the account was, in fact, subject to interest, as evidenced by a previous letter from another debt collector that listed a lower balance. Therefore, the suit argues, the letter violated the FDCPA by failing to provide the plaintiff with the information he needed to calculate the amount he truly owed.
