Nationwide Credit, Inc. is facing a proposed class action that claims it violated the Fair Debt Collection Practices Act by failing to clearly communicate the amount of consumers’ alleged debts.
Nationwide Credit, Inc. is facing a proposed class action lawsuit that claims it violated the Fair Debt Collection Practices Act (FDCPA) by failing to clearly communicate the amount of consumers’ alleged debts. The two plaintiffs in the case say they received collection letters from the defendant setting forth their “account balance” and indicating that the amount “is subject to timing and system limitations.” The suit argues that this language is ambiguous, lacks explanation, and leaves the unsophisticated consumer unsure as to how much he or she owes.
