A New York woman is behind a proposed class action that alleges Nationwide Credit, Inc. sent her a collection notice that violated the Fair Debt Collection Practices Act (FDCPA). The named plaintiff argues the defendant’s collection notice unlawfully tried to pressure her, i.e. the “least sophisticated consumer,” into making payment by claiming her charged-off credit card balance was subject to “timing and system limitations.” Upon information and belief, the complaint continues, the plaintiff’s supposed overdue credit card debt, since it was charged off, was not subject to any change, and would never increase per the terms of its original agreement.
