A California consumer is behind a proposed class action in which he alleges Nationstar Mortgage LLC, doing business as Mr. Cooper, conducted an unauthorized credit inquiry.
A California consumer is behind a proposed class action in which he alleges Nationstar Mortgage LLC, doing business as Mr. Cooper, conducted an unauthorized credit inquiry that violated the Fair Credit Reporting Act (FCRA). The plaintiff claims that he was solicited by Nationstar about re-financing his property and, after discussing his options, determined he was not ready to move forward. The complaint says the plaintiff then received a notice from Nationstar in August 2017 titled “Credit Score Disclosure,” indicating Nationstar performed a credit check that the man argues falls outside any use permitted under the FCRA.
“[The plaintiff], at no time, consented to submitting a credit application,” the lawsuit asserts. “[The plaintiff], at no time, consented to having his credit report pulled by [the defendant].”
