New York
Nations Recovery Center, Inc. is on the receiving end of a proposed class action lawsuit that claims it sent a New York man a “misleading” debt collection letter. According to the suit, the plaintiff received a notice from Nations Recovery that stated a “Judgment Date” of 08/21/2009 and set forth his remaining balance but failed to inform him that the amount was increasing due to post-judgment interest. The complaint argues that the alleged non-disclosure could unlawfully mislead the unsophisticated consumer into thinking payment of the amount stated in the letter would settle his or her account, when, in reality, the balance was accruing interest each day the debt remained unpaid.
