The National Republican Senatorial Committee faces a proposed class action that alleges the political organization has sent spam texts to consumers nationwide without consent.

The National Republican Senatorial Committee (NRSC) faces a proposed class action lawsuit that alleges the political organization has sent spam text messages to consumers nationwide without consent.
The plaintiff, a Jefferson County, Alabama resident, alleges in the nine-page case that the NRSC sent her between late summer 2021 and January 2022 numerous texts in an effort to solicit political donations. The consumer claims to have not had any prior association with the NRSC, nor donated to any Republican political candidate.
According to the lawsuit, the NRSC sent the generic, pre-written texts at issue by way of an automatic telephone dialing system, in violation of the federal Telephone Consumer Protection Act (TCPA).
Under the TCPA, it is unlawful for anyone to make a call, other than for emergency purposes, using any automatic telephone dialing system, or an artificial or pre-recorded voice, unless such a call is made solely to collect a debt owed to or guaranteed by the United States, the lawsuit says. The NRSC did not possess the requisite prior express consent to send automated text messages to consumers, the suit states.
The plaintiff and similarly situated consumers are entitled to an award of $500 in statutory damages for each violation of the TCPA, the lawsuit claims.
“Plaintiff never consented to or agreed to any communication with NRSC,” the case attests.
The lawsuit looks to cover all individuals in the United States who received a call or text from the National Republican Senatorial Committee, without prior express consent, on their telephone at any time within the last four years.
