A New York consumer claims in a proposed class action that National Recovery Agency sent him a deceptive debt collection notice that violated the FDCPA.
A New York consumer claims in a proposed class action that NRA Group, LLC—which does business as National Recovery Agency—sent him a deceptive debt collection notice that violated the Fair Debt Collection Practices Act (FDCPA).
The suit says the letter included language that misled the plaintiff regarding his debt amount. The notice, dated November 2017, allegedly stated, in part:
“PLEASE NOTE THERE MAY BE SOME ADDITIONAL ACCOUNTS NOT REFLECTED ABOVE.”
The defendant’s reference to “additional accounts” confused the plaintiff as to whether he owes an amount greater than what was indicated in the letter, the case argues. The suit claims the notice failed to adhere to FDCPA requirements as it was “susceptible to an inaccurate reading by the least sophisticated consumer.”
