Aronova et al v. National Bureau Collection Corporation
Filed: January 25, 2017 ◆§ 7:17-cv-00572
Four named plaintiffs are behind a proposed class action against National Bureau Collection Corporation over alleged violations of the Fair Debt Collection Practices Act.
New York
Four named plaintiffs are behind a proposed class action against National Bureau Collection Corporation over alleged violations of the Fair Debt Collection Practices Act (FDCPA). The lawsuit claims the defendant, in its communications with the plaintiffs, failed to clearly provide the amount of debt owed, specifically with regard to whether the plaintiffs’ respective debt amounts would increase due to the undisclosed accrual of interest or fees.
The suit takes particular issue with certain language allegedly included in the defendant’s collection notices:
“The qualifier, ‘as of the date of this letter,’ would likely lead the least sophisticated consumer to be uncertain as to whether the amounts stated in the letters was accurate only ‘as of the date of [the] letter.’”
