A proposed class action has been filed against Naples Hotel Group, LLC by two Florida women who claim the defendant unlawfully failed to provide prospective employees with proper background check authorization forms and disclosures of their rights.
A proposed class action has been filed against Naples Hotel Group, LLC by two Florida women who claim the defendant unlawfully failed to provide prospective employees with proper background check authorization forms and disclosures of their rights. The plaintiffs say they applied for employment with the defendant and signed forms purporting to authorize background reports. According to the suit, the defendant failed to comply with the Fair Credit Reporting Act because the background check forms provided to the plaintiffs contained “extraneous provisions.” Moreover, Naples Hotel Group also allegedly failed to provide the plaintiffs with a standalone authorization form containing only a disclosure of the women's FCRA rights.
Further, the complaint argues that the defendant took adverse action against the plaintiffs in neglecting to hire them without first providing the women copies of their background reports and an explanation of their rights as mandated under the FCRA. As a result, the case says, the plaintiffs were denied an opportunity to respond to information in the reports or dispute possibly inaccurate information.
This suit was originally filed in state court and has since been moved to federal court in Florida.
