The 11-page lawsuit says that despite the prominent front-label claim that the crackers are made with whole grain flour, the product’s ingredients list indicates that it primarily contains “unbleached enriched flour.” The false advertising suit alleges the item’s packaging is misleading to consumers given that the amount of whole grain flour used in the item is negligible compared with its enriched flour content.
According to the case, products made with whole grain flour contain key nutrients and vitamins that items made with refined flour lack. Enriched flour, for example, loses dietary fiber—an important nutrient found in whole grain flour—during the refining process, the complaint explains. As such, products made with whole grain flour are perceived to be healthier than those made with other types of flour, the filing relays.
The class action lawsuit argues that the company has wrongfully profited at the expense of consumers as a result of the alleged misrepresentation.
The plaintiff, a New York resident who bought the product at issue in March 2024, says she believed, based on the representation, that the crackers’ main flour ingredient was whole grain flour. The woman claims she would not have purchased the item had she known it was falsely advertised.
The Mondelēz Global lawsuit looks to represent anyone who purchased Nabisco Premium whole grain saltine crackers within New York during the applicable statute of limitations period.
