The plaintiff, whose number has supposedly been listed in the National Do Not Call Registry since 2004, alleges that the defendant began sending her texts in September 2018 in an effort to promote events at its Broward County, Florida location. The automated texts were sent without the woman’s prior express consent and failed to provide any opt-out instructions, the suit claims.
