The 25-page My Daily Choice data breach lawsuit relays that on February 15 of this year, the online retail and multilevel marketing company detected suspicious activity within a third-party hosted network where it stores data. An investigation revealed that an unauthorized actor stole customers’ names, financial information and Social Security numbers the same day the suspicious activity was identified, the complaint says.
According to the case, the cyberattack was a result of the defendant’s failure to adopt and maintain adequate cybersecurity measures. The filing notes that My Daily Choice had a legal duty to safeguard consumers’ personal data against unauthorized access and disclosure, a precaution that is particularly important in recent years due to the substantial increase in cyberattacks.
The data breach lawsuit says the company waited until around June 5, 2024 to begin notifying data breach victims, who now face a “heightened and imminent” risk of financial fraud and identity theft.

“Data breaches are more than just technical violations of their victims’ rights,” the filing reads. “By accessing a victim’s personal information, the cybercriminal can ransack the victim’s life: withdraw funds from bank accounts, get new credit cards or loans in the victims’ [sic] name, lock the victim out of his or her financial or social media accounts, send out fraudulent communications masquerading as the victim, file false tax returns, destroy their credit rating, and more.”
The plaintiff, a MyDailyChoice.com customer who received a letter from the company stating that her information was exposed in the breach, says her credit score dropped about 200 points following the cyberattack. Like other affected individuals, the woman must now closely monitor her personal accounts and pay out of pocket for protective services to guard against the “certainly impending” threat of fraud, the filing claims.
The case also argues that My Daily Choice has withheld “crucial” information about the incident from impacted consumers, including details about how cybercriminals were able to exploit vulnerabilities in its security systems, which third-party vendor it used to host their data and what specific steps the company has taken to ensure that such an attack does not occur again.
The lawsuit looks to represent anyone whose personal information was accessed by unauthorized persons in the My Daily Choice data breach, including anyone sent notice of the incident.
