A $1,670,000 settlement has been reached to resolve a proposed class action lawsuit that claimed Change Healthcare, operating as My Advocate, illegally placed prerecorded calls on behalf of Blue Cross Blue Shield of North Carolina without obtaining consent from recipients.

The deal was preliminarily approved by the court on July 17, 2024, and the official settlement website can be found at MyAdvocateSettlement.com.
The settlement covers anyone to whom Change Healthcare Resources, under the brand My Advocate and calling on behalf of Blue Cross Blue Shield of North Carolina (BCBSNC), placed a call to their cell phone using an artificial or prerecorded voice and was not a member or subscriber of BCBSNC, or who opted out of receiving calls from Change Healthcare, at any time from January 10, 2019 to July 17, 2024.
According to the site, class members are eligible to receive a pro-rated share of the settlement fund.
Covered individuals who have been identified in the defendants’ records and received a mailed notice about the settlement will automatically receive payments in the form of a check, the settlement website shares.
Class members who have not received notice of the deal must file a valid, timely claim form through the settlement website to receive benefits. Settlement notice recipients can also file a claim to receive payment electronically.
To submit a claim form, head to this page and enter the claim ID and PIN located in your settlement notice, if applicable. The claim form filing deadline is December 2, 2024.
Payments will be made if and when the My Advocate robocall settlement is granted final approval from the court, and after any appeals are resolved. A final approval hearing is slated for December 16, 2024.
The initial My Advocate lawsuit alleged Change Healthcare Resources violated the Telephone Consumer Protection Act (TCPA), a federal law that restricts telephone solicitations and the use of automated phone equipment, such as artificial or prerecorded voice calls.
