Keeping with the theme of the latest case filings that have come across our wire, a proposed class action alleging violations of the Fair Debt Collection Practices Act (FDCPA) has been filed against Mullooly, Jeffrey, Rooney & Flynn LLP, a debt collection group from Syosset, New York. According to the lawsuit, the defendant sent the plaintiff a collection notice that failed to state the total amount of debt owed. The plaintiff claims the amount listed in the notice unlawfully included undisclosed costs, disbursements, and fees.
“The statement of a ‘total amount,’ without notice that the amount is already increasing due to other charges, would mislead the least sophisticated consumer into believing that payment of the amount state will clear his or her account,” the lawsuit says.
