On the heels of a similar proposed class action filed last week in Wisconsin, another lawsuit against MRS BPO, LLC alleges the company violated the Fair Debt Collection Practices Act (FDCPA) in collection notices sent for obligations believed to be owed to Chase Bank, N.A. The latest action, filed in New York, claims the defendant unlawfully failed to clearly state the name of the creditor to whom the plaintiff’s debt was owed.
The consumer who filed the lawsuit alleges the defendant’s collection notice lists “Re: CHASE BANK USA N.A.,” yet does not indicate if that refers to the account owner, creditor, current creditor, or original creditor, nor does it clearly name the entity to whom the plaintiff should make a payment.
