Shine, Inc., a company that sends out motivational text messages, is facing a case claiming it violated the Telephone Consumer Protection Act.
Shine, Inc., a communications company that sends consumers motivational text messages daily, is the defendant in a proposed class action alleging it may have sent one too many text messages. Citing alleged violations of the Telephone Consumer Protection Act (TCPA), the 14-page lawsuit claims that while attempting to promote its services, Shine sends consumers texts without first obtaining prior express consent. A step further, the case alleges Shine continues to send texts even after receiving express requests—texts from consumers reading “STOP”— that the messages cease.
