More Class Action Trouble for Debt Collector Alltran Financial
Last Updated on May 8, 2018
Choi v. Alltran Financial, LP
Filed: February 27, 2018 ◆§ 1:18cv1251
According to a lawsuit, Alltran Financial failed to disclose in a collection notice whether the plaintiff's debt was accruing interest.
A consumer in New York alleges in a proposed class action that Alltran Financial, LP mailed a collection notice that unlawfully failed to disclose whether the amount owed may increase due to interest. The complaint charges that Alltran violated the Fair Debt Collection Practices Act (FDCPA) by failing to clearly convey the amount of debt from “the perspective of the least sophisticated consumer,” such that it would allow the individual to determine the minimum amount owed at the time a notice is sent, as well as how much he or she would need to pay to get rid of the debt “at any given moment in the future.”
