Debt collection agency Monarch Recovery Management has been hit with a class action lawsuit out of Florida claiming the company violated both the TCPA and the FDCPA.
Debt collection agency Monarch Recovery Management has been hit with a class action lawsuit out of Florida claiming the company violated both the Telephone Consumer Protection Act (TCPA) and the Fair Debt Collection Practices Act (FDCPA). The 11-page complaint details allegations that the company used automated “predictive” telephone dialing equipment and prerecorded messages when placing debt collection calls. According to the suit, the defendant would continue to place debt collection calls to consumers even after being told that they called the wrong person. The proposed class is broken into two subclasses, a TCPA class and an FDCPA class.
