The eight-page case claims MobileHelp has run afoul of the Telephone Consumer Protection Act, a federal law that prohibits companies from using an artificial or prerecorded voice message to make telemarketing calls without first securing the recipient’s permission to do so.
The plaintiff, whose cell phone number has been listed on the National Do Not Call Registry since May 2021, says he received at least three prerecorded calls from the defendant later that year.
According to the filing, the calls began with an audible click and a delay, followed by a “generic recorded message” advertising MobileHelp’s medical alert systems. The plaintiff says that after the prerecorded message concluded, he spoke with an individual who said she was a MobileHelp employee and that he would be receiving an email about the offer the call advertised.
Per the complaint, the plaintiff never provided his express written consent to receive such telemarketing calls. In fact, the suit says a number of consumers have posted complaints online about receiving unsolicited robocalls from MobileHelp, which allegedly hires employees to cold call consumers and uses dialers to place prerecorded voice messages en masse.
The lawsuit looks to represent anyone in the United States who, within the past four years, received a call to their cell phone from MobileHelp or any third party acting on its behalf that used the same or similar artificial or prerecorded voice message used to call the plaintiff.
