Filed: October 25, 2017 ◆§ 2:17-cv-00940-ALM-EPD
A lawsuit filed in Ohio claims the hearing aide maker cold-called consumers cell phones, even some numbers included in the National Do Not Call Registry.
Hearing device retailer Miracle-Ear, Inc. is on the receiving end of a proposed class action claiming it cold called consumers’ cell phones without consent. The plaintiff, whose number is on the National Do Not Call Registry, the case says, claims the defendant placed unsolicited telemarketing calls in July and September 2017 without written permission to do so. Prior to filing the lawsuit, the plaintiff says he wrote to Miracle-Ear asking for it to produce evidence that they had consent to call him.
