According to the 13-page Mielle lawsuit, defendants Mielle Organics LLC and the Procter & Gamble Company do not disclose anywhere on the product’s labeling or packaging, or in marketing materials, that the hair oil carries a “high risk” of causing hair loss.
“To the contrary, [the defendants] represented and warranted, expressly and impliedly, that the product was safe and effective for their intended use, were of merchantable quality, and complied with federal and state law,” the case contends.
The Mielle class action lawsuit alleges that the companies made no reasonable effort to test the Mielle Organics hair oil for ingredients that could lead to hair loss. Per the case, these ingredients would have been detected had the defendants met their quality assurance obligations.
“Accordingly, [the defendants] knowingly, or at least negligently, introduced a harmful and/or misbranded product containing into the U.S. market,” the suit argues.
When the plaintiff, a Massachusetts resident, bought the hair oil, the woman reasonably believed the Mielle product was properly manufactured and safe for its intended use, the filing says. The plaintiff had no way of knowing that the hair oil would cause her hair loss due to the defendants’ fraudulent misrepresentations and omissions, the Mielle lawsuit contends.
The filing argues that consumers would not have paid as much for the hair oil, or they would not have bought the product at all, had they known it could result in hair loss.
The Mielle class action lawsuit looks to represent anyone in the United States who purchased Mielle Organics Rosemary Mint Scalp & Strengthening Hair Oil for personal or household use within the applicable statute of limitations period.
