A lawsuit has been filed against Midland Funding, LLC, its affiliate, and its parent company for allegedly violating the Fair Debt Collection Practices Act.
A proposed class action has been filed against Midland Funding, LLC, its affiliate, and its parent company for allegedly violating the Fair Debt Collection Practices Act (FDCPA), which prohibits the use of “false, deceptive, and misleading collection practices.” The plaintiff claims the debt collector left her a message on her telephone in an attempt to collect an alleged debt, but failed to clearly identify itself as a debt collector or state its intent to collect a debt. The suit says the defendant intentionally leaves vague messages on consumers’ phones in order to “trick” them into returning the call and providing personal information.
