Midland Credit Management, Inc. was hit with a proposed class action lawsuit over an allegedly contradictory collection letter the defendant sent to a New York consumer.
New York
Midland Credit Management, Inc. was hit with a proposed class action lawsuit over an allegedly contradictory collection letter the defendant sent to a New York consumer. According to the complaint, the letter contained the following statements:
The law limits how long a debt can appear on your credit report. Due to the age of this debt, we will not report payment or non-payment of it to a credit bureau. The case argues that these statements contradict each other and would leave the unsophisticated consumer unable to determine whether the defendant was permitted to report the alleged debt.
You are hereby notified that a negative credit report reflecting on your credit record may be submitted to a credit reporting agency if you fail to fulfill the terms of your credit obligations.”
