Microsoft Corporation Welfare Plan and Microsoft Corporation are facing a lawsuit filed by two sets of parents on behalf of their minor children who the suit says were unlawfully denied coverage for treatment of their mental health conditions.

Microsoft Corporation Welfare Plan and Microsoft Corporation are facing a proposed class action lawsuit filed by two sets of parents on behalf of their minor children who the suit says were unlawfully denied coverage for treatment of their mental health conditions. According to the complaint, the children are beneficiaries of their parents’ employee healthcare plan and participants in outdoor/wilderness behavioral healthcare programs for which the defendants allegedly refused to pay.
The suit argues that under federal law, health plans offering mental health coverage must provide the same level of coverage as medical/surgical benefits and cannot impose additional restrictions or limitations that are only applicable to mental health treatment. The plaintiffs claim the defendants pay for medically necessary treatment at skilled nursing facilities and therefore must cover mental health treatment offered through residential healthcare facilities such as wilderness therapy programs.
According to the complaint, the plaintiffs were unfairly forced to pay out of pocket for medically necessary mental health treatment that should have been covered under their health plan.
