Micro Matic USA Facing Age Discrimination Allegations

Doritty et al v. Micro Matic USA, Inc.
Filed: July 13, 2017 ◆§ 8:17-cv-01679-EAK-AEP
Five plaintiffs claim Micro Matic USA terminated at least 10 employees between 50 and 60 years old due to their age.
Micro Matic USA, Inc., a manufacturer and supplier of beer keg valves and dispensing equipment, is the defendant in a proposed class action filed by five plaintiffs who allege they were fired by the company because of their ages. The plaintiffs claim “at least 10 employees in the age group of 50 through 60” years old were terminated within one week of each other for somewhat shaky reasons that ostensibly stemmed from superiors not caring for the workers’ “negativity” or attitude changes, among other ambiguous explanations.
The complaint lays out an alleged pattern and policy employed by Micro Matic of wielding its aggressive discipline policy, in which employees will be fired should they be involved in negative incidents within 30 days of a “suspension,” as a convenient tool to ensure its work force is comprised mostly of young, temporary employees.
“Defendant, as a practice, hires young employees, most of whom are young temporary employees,” the case argues. “Approximately half (50-60 of the employees) of the entire staff of 120 employees at the Brooksville, Florida location are temp employees. In October 2015 alone, approximately 52 younger workers were hired but no older workers for similar positions to [a plaintiff].”
